TERMS OF SALES
These Terms and Conditions of sales govern the sale of any product on the website www.valome.fr by: GDLuxury7 SAS company with a €50.000 capital based in Lyon France, 111 rue Cuvier 69006, registered with the Trade and Companies Office under SIRET number 797 429 271.
The action of placing an order means full acceptance of the General Conditions of sales that are permanently available on the website, including during the order recording. We recommend that you print and keep a copy of these Terms and Conditions of sales for future reference. Unless proved otherwise, information that we record constitute proof of transactions, along with their date.
The Terms and Conditions of sales are the only agreement between the parties, thus prevailing over any other document. Modification is possible at any time. New Terms and Conditions of sales shall apply to all orders made after having them available on the website. In the occuence that, subsequently to the date of their removal at www.valome.fr, Terms and Conditions of sales that could remain accessible to the public through other websites or by any other means would not be enforceable to GDLuxury7.
Orders placed on the website are only for individuals and end-buyers, other than for resale. The resale of Valôme items is prohibited to any buyer who would trade in a professional capacity.

Attention : regarding items or custom made orders, you do not have a withdrawal right. For collection items, you have a period of 14 days following receipt of your order to exercise your withdrawal right, without penalty and motive..
ARTICLE 1 - TWO TYPES OF ITEMS ARE OFFERED FOR SALE ON OUR WEBSITE
• Collection items, which are recurrent products from Valôme’s range ; • Items made to order or customized. Offers and products made by GDLuxury7 are limited by stock conditions. Information regarding availability are provided when placing the order..
ARTICLE 2 - UNIT AND TOTAL PRICES OF ORDER
Price of items are all taxes included (VAT rates in force on the date of registration of the order), excluding transport costs are in Euros. They can be changed without notice knowing that the items are billed based on the rate in force at the time of the order.
The total amount of the order you are planning to pay for is indicated on the screen "Summary" of your order, and includes the following information: • Price including VAT of the articles • Transportation costs (free or not depending on the order).
ARTICLE 3 - ORDER
To order, it is important to follow the steps as follows:
PHASE 1: Select your item (s): • For articles issued from collection: color selection and model;
PHASE 2: Access to the "CART" • indication of the carrier along with indicative delivery dates ; • Access to the Phase 3 is made by selecting the “ORDER” button
PHASE 3: Validation of the order in 3 steps:
1. Identification: Creating your customer account or authentication through an existing customer account
2. Order summary:
o banking and postal information: • Intelligence shipping addresses and billing • Information bank details
o Visualization balance of your order: • Items ordered and total amount of the order, • Indication of the carrier and mention of the / of the date (s) indicative (s) Delivery
o Acceptance of Terms of Sale
o Final confirmation of the order by clicking on the button "MAKE PAYMENT"
3. Order confirmation • You will receive a printable order confirmation by email and this will be your purchase order, also containing these Terms and Conditions of sales, contact of our online sales Service, and information on your right of withdrawal. • Receiving an email confirmation upon shipment of the order (Note : you cannot answer this email). The invoice will be sent by e-mail at the time of shipment of your order. We take the right not to honor an abnormal order or made in bad faith, and for any other legitimate reason in accordance with Article L.122 1 from Consumer code. The customer bears telecommunication costs when accessing the Internet and using the website www.valome.fr
ARTICLE 4 - PAYMENT
Payment of purchase is made by credit card (Visa, Visa, Eurocard / Mastercard, American Express) or Paypal when placing your order. Regarding the flow of your credit card, it will be made no later than six (6) days after placing your order, in the thereof currency.
The purchases you make on our site are done securely via the website of a licensed bank and in a secure environment (SSL). The banking information you provide is therefore in a secure environment. Payment card numbers are not kept on our website but on that of a secure bank.
To fight against fraudulent uses when making electronic payments, we check the reliability of the information entered during order validation. We therefore proceed to a cross-referencing between address of the credit card and billing address. We therefore can request some additional documents helpful in this process (proof of address, photocopy of identity card etc.) to validate your purchase and proceed your order. Such requests may be made by phone or email:
•For new customers ;
•For an order with a different billing and delivery address ;
•For amount above €200 ;
•For any other legitimate reason.
GDLuxury7 remains owner of items sold until full payment, VAT and transportation costs have been made.
ARTICLE 5 - DELIVERY - DESTINATION
Items we offer on our site can be delivered worldwide. You will be delivered to the address specified in your order.
We will refuse any delivery in an army mailbox, a general delivery, in a postal area, or in a mailbox. We are in charge of insuring products until delivery.
5.1. TRANSPORTATION COSTS AND DELIVERY
Prior to order validation, transport costs will be indicated. They depend on the delivery address as well as the total amount of your order.
5.2. TIME - DELIVERY
Under provisions of the Consumer Code, delivery of ordered products will occur within the time provided by Valôme (GDLuxury7) and, failing any indication, no later than thirty (30) days from order time, subject to full payment.
However deadlines provided by Valôme (GDLuxury7) are only instructive information. You have not received your order within the specified time. You have received an e-mail confirming the shipment but did not receive the order within the indicated time : we recommend that you contact the carrier concerned and our online sales service at contact[at]valome.fr
•If you have not received any shipping confirmation, and that the indicative delivery date on your order confirmation is exceeded : We recommend that you contact as soon as possible our online sales service at contact[at]valome.fr
•If you do not receive your order seven (7) days following the stated delivery date, for any other case than force majeur; the sale may be canceled (by registered letter with receipt, as provided in Article L121-20-3 of the Consumer Code). You will have the opportunity to exercise this right within a period of 60 days from the delivery date. However, we invite you to contact as soon as possible our online sales service at contact[at]valome.fr.
After verification, our team will tell you how to take back your/your product(s). The full amount paid will be refunded (including transportation costs related to the product(s) concerned) within 30 days from the date you exercised your right.
5.3. RECEPTION - DELIVERY
On receipt of your order, please check package and product condition, as well as the conformity of your order. In case you notice a damaged item, we ask you to indicate it on the carrier form, and then contact our online sales service at contact[at]valome.fr. During this exchange, please specify observed damages (holes, opening, etc.).
In all cases, you have a period of three (3) days, excluding holidays, after receiving the parcel to inform the carrier by extrajudicial document or letter all reservation you could have (Article L133-3 of Commercial Code). • In the event delivered good(s) would not correspond to your order, you will have the opportunity to send back in accordance with the return procedures hereinafter
ARTICLE 6 - RIGHT OF WITHDRAWAL - RETURN
Apart from the cases under sections 2.2. (Delivery delay), section 5.1. (Legal Guarantees) and section 5.2. (Warranty), you will have the opportunity to exercise your right of withdrawal under the following conditions:
6.1. ARTICLES ON ORDER OR CUSTOM
Given the uniqueness of customized articles, these cannot be returned or exchanged following Article L121-20-2 of the Consumer Code: "The right of withdrawal may be exercised, unless parties agree otherwise, for contracts: (...) 3 ° creation of goods made to the consumer's specifications or clearly personalized ...". Therefore, you can not claim any right of withdrawal. Also, we recommend that you customize your product carefully.
6.2. ARTICLES COLLECTION
You have a period of fourteen (14) days from the receipt of your order to exercise your right of withdrawal, in accordance with the Article L121-20 of the Consumer Code.
Simply contact our online service sale to the following address: contact[at]valome.fr. After validation, we will give you a return number to register on the Return Form. You also have a special procedure on the website once you log in in your personal account.
We take for commitment to refund returned item and shipping costs (two-way) related to this article, whichever is the least expensive mode of transport for France only.
For other destination than France, we take for commitment to refund only one way shipping costs related to this article whichever is the least expensive mode of transport. Reimbursement will be made by crediting the bank account that was used for the order payment, at the latest within thirty (30) days from the date this right was exercised (Article L121-20-1 of the Code of the consumption).
It is imperative to return the full article (notice, accessories etc.) in its original condition with packaging, a copy of your invoice and the completed return form. In case the returned items are incomplete, soiled, damaged or deteriorated, they will not be reimbursed.
ARTICLE 7 - EXCHANGE
7.1. MADE-TO-ORDER PRODUCTS
Given the uniqueness of made-to-order products, these articles cannot be exchanged.
7.2. ARTICLES ISSUED FROM COLLECTION
Return of articles from collection can only be done with other articles of equal or greater value within fourteen (14) days.
Therefore, refunds can only be effective through exchange procedure. In case you want to exchange purchased item for another of greater value, you will pay the difference between the value of the article and the previous one ordered.
It is imperative to return the full article (notice, accessories etc.) in its original condition with packaging, a copy of your invoice and the completed return form. In case the returned items are incomplete, soiled, damaged or deteriorated, they will not be exchanged.
ARTICLE 8 - LIABILITY - GUARANTEE - AFTER SALES SERVICE
8.1. LEGAL GUARANTEES
Valôme products (GDLuxury7) benefit from legal guarantee of compliance and are guaranteed against hidden defects, in accordance with legal provisions (Articles L211-1 to L212-1 of the Consumer Code - Articles 1641 to 1649 of the Civil Code).
You have a period of two (2) years to invoke these guarantees to the after sales service. This period starts from the delivery of purchased items for legal compliance (Article L211-12 of the Consumer Code), and discovery of defects for the warranty against hidden defects (Article 1648 of the Civil Code).
As part of the implementation of legal guarantees, we invite you to contact as quickly as possible our online sales service at contact[at]valome.fr. After verification, we will tell you how to take back your product(s).
Products offered are in accordance with regulations. They benefit from the quality and expertise of Valôme (GDLuxury7). Therefore, they are guaranteed against manufacturing defects. In case such a defect occurs, Valôme (GDLuxury7) will repair your purchase free of charge, or exchange it.
Once an exchange occurs, defective items are not returned. However, Valôme (GDLuxury7) guarantee does not cover normal wear or accidental damage or those caused by the use of a solvent or by abnormal use of the article. As part of the implementation of Valôme (GDLuxury7) guarantee, please get in touch as soon as possible with our online sales serice at contact[at]valome.fr.
After verification, we will tell you how to take back your / your product (s). Our workshop will take the appropriate decision regarding your article: • In case of a proven manufacturing defect validated by our workshop, a free repair of your article, or a replacement by a new item of equivalent value will be made; • In case of a used article, the repair will have to be paid. We will offer you a quoting as soon as the damage occurs from your own or someone’s else doing. • Finally, if your article is well-worn, it will not be repaired and will be returned to you.
GDLuxury7 can not be held accountable for possible "screen / reality" color differences, due to screen parameters, even though it would be a gift.
Also in cases of force majeure, we can not be held responsible for any delay or failure. Are considered as such, including but not limited to : war, riots, insurrection, civil unrest, strikes of any nature and supply problems from Valôme (GDLuxury7). Valôme (GDLuxury7) informs customer of such a force majeure event within seven (7) days following its occurrence.
If this event does continue beyond fifteen (15) days, customer would have the right to terminate its current order, which would result in a refund as stated in the terms of Article 8 of these Terms and Conditions of sales. Being recalled that any handover command is prohibited to minors, we could not be held responsible for a command that was passed by a minor, the parents having or not authorized this command.
ARTICLE 9 - DATA PROTECTION
Personal data are required to process your order and are at no time intended to be sold, marketed or rented to third parties. You have the right to access, modify, or rectify and make opposition in respect to your information, by contacting us at contact[at]valome.fr.
ARTICLE 10 - INTELLECTUAL PROPERTY
Intellectual property rights on the site and all its components (trademarks, designs, copyrights, domain names ...) are subject to an ownership right or an exclusive use for the benefit of Valôme (GDLuxury7). Total or partial reproduction of the website, without express agreement of Valôme (GDLuxury7), is prohibited except for personal and private use, excluding any commercial purpose.
ARTICLE 11 - APPLICABLE LAW - DISPUTES
These Terms and Conditions of sales, the order and all documents arising from them are governed by French law. In case of dispute, and failing amicable settlement, French courts will have exclusive jurisdiction.
